Dated? Dec 3rd 1838
In the name of God Amen
I Eli Sparrow of Sumter District and State of South Carolina being of sound mind memory and calling unto mind the shortness of life and the certainty of death, do make this my last will and testament——-1st I commit my soul into the hands of almighty god that gave it and my body to be buried in a decent Christian manner and as touching my worldly goods I make the following disposition (viz) I give unto six of my children (Viz) Susan, Martha, John, Eliza Suffrona, and Abigail Sparrow all of my Estate, my lands, negroes, horses, cattle, hogs, household and kitchen Furniture and all other articles not mentioned (after paying my just debts), to be equally divided between all the above named heirs either by partition or sale as may be thought best by my Executor and three neighboring free holders to be selected for that purpose and lastly I nominate constitute and appoint my son William Sparrow Executor to this my last will and testament revoking and disannulling all other wills or instruments as wills as I hereunto set my hand and seal this seventeenth

Personally appears before me Alfred Scarborough who being truly sworn sayeth that he was personally present and saw Eli Sparrow sign seal publish and declare the writing? Instrument of writing to be and certain his last will and testament that he the said Eli Sparrow was at the time of sound and disposing mind memory and understanding as far as he (this dissonant?) knoweth and believes and that Jarvis Scarbough and William Sparrow together with himself? (this dissonant?) died? Subscribe their names and witnesses thereunto at the request of the testator in his presence and in the presence of each other.

Sumter District Whereas the last will and testament of Eli Sparrow Decd. Directs for his Exr. And three neighboring free holders to convene and divide the whole of the estate between six heirs named in his will, either by partition or sale as may be that list (?) by the said Exr (Executor) and free holders and at the request of the said Exr. we have this day met together on the promises of the said Eli Sparrow Decd and have taken the matter into consideration and after matun(?) deliberation have come to the unanimous conclusion that the Est (Estate) cannot be divided by partition to the advantage of the said Legatus? We therefore say that the Exr. give proper notice by advertising and then sell to the highest bidder the whole Est. pay all just debts and divide the residue between the said six legal heirs of the said Eli Sparrow Decd—–given undue our hands this 8th day of Decd AD 1838.
