Know all men by these presents that we Ira HEATH and Jesse PHILLIPS are held
and firmly bound unto JOHN BAKER in the sum of fifty dollars to the true and
faithful Payments of which sum we bind ourselves our heirs, executors and
administrators jointly and severally by these Present signed with our hands
and sealed with our seals.
The condition of this obligation is such that whereby the above bounden Ira
HEATH hath since ? out an attachment against the estate of the said John BAKER
returnable before a justice of the Peace for the sum of three dollars & twenty
cents now therefore if the said Ira HEATH shall prosecute the said suit with
ejectment case he fail the sum shall will and truley pay to the said BAKER all
such costs and damages as shall hereafter be reverable against him the said
HEATH in consequence of having unrongfully sould out said attachment them —
us to be void otherwise to recover in full force and affect.

We, James JONES, Justice of the Peace of said County and Oliver HERRING,
Samueal HOWARD and Jese W.? KINCEY freeholders in obedience to the next order
proceded on the 12th day of October to view the Estate of Evan NOBLE, Deceased
and out of the crop stock and provision on hand we have laid off and alloted
to Leah? NOBLE, widow as follows that is to say thirty barrels of corn one
thousand pounds of pork fifty pounds of lard one beef fifty pounds of sugar
twenty five pounds of coffee five gallons of molases fifteen hundred pounds of
fodder four bushels of pees, pepper and spice two pounds each one and a half
bushels of clean rice five gallons of vinegar five gallons of spirits, fifty
bushels of potatoes five bushels of slips? Four bushels of salt two barrels of
flower one on hand ginger one pound and we have further laid of and allotted
to the said Leah NOBLE one bed and its necessary furniture and one wheel and
pair of cards? As her absolute property and put her in possession of the of
the same.

I Isaac SPARROW of the county of Lenoir in the State of North Carolina are
indebted to Wm. HUNTER of Lenoir County in said State in the sum of Thirty
Five Dollars for which he holds my note to be due the first day of October AD
1882 and to secure the payments of the same I do hereby convey to him these
articles of personal property to wit: One sorrell Horse, all my hogs and
cattle & one cart. All my crop of corn, Cotton, turpentine raised by me during
this year.
But on this Special Trust that if I fail to pay said debt and interest on or
before the first day of October AD 1882 then he (Wm. HUNTER) may sell said
property or so much thereof as may be necessary by Public Auction for Cash,
first giving me five days notice at Three Public Places and apply the proceeds
of such sale to the discharge of said debt and interest on the same and pay
any surplus to me.

I, Isaac SPARROW, of the County of Lenoir, in the State of North Carolina, am
indebted to L. HARVEY of Lenoir County, in said State, in the sum of Fifty one and 25/100 dollars, for which he holds my note, to be due the 15th day of October, A.D., 1885; and to secure the payment of the same, I do hereby convey to him these articles of personal property, to wit:
One sorrel blaze face horse about 11 years old, my cart and farming tools & all the crop of corn, cotton & other produce to be raised by me during the year 1885 & on my land and elsewhere.
But on this Special Trust: That if I fail to pay said debt on or before the 15 day of Oct., A.D. 1885, then he may sell said property, or so much thereof as may be necessary, by Public Auction, for cash, first going Twenty Days Notice at Three Public Places, and apply the proceeds of such sale to the discharge of said debt and interest on the same, and pay any surplus to me.

On the1st day of October 1880, I promise to pay J. A. PRIDGEN or order Fifty
Dollars for advances heretofore made to me and hereafter to be made to me in
supplies by said J. A. PRIDGEN (in accordance with an Act entitled “An Act to
Secure Advances for Agricultural Purposes”, ratified March 1st 1867) to
cultivate a crop for the Year 1883 not to exceed, in addition to what has been
heretofore advanced to me the sum of One Hundred Dollars.
To secure the payment of the same, I hereby constitute this a LIEN on the crop
of Corn, Cotton, and other produce to be raised by me during the year 1880 in
Lenoir County on the land of Isaac SPARROW in Pink Hill Township adjoining
Mike ? C. Lawrence and others.
And, for further security I hereby convey to the said J. A. PRIDGEN the
following articles of personal property – one yellow mare, one work ox, one
milk cow and one cart – all which is free from incumbrance of any kind.
But on this Special Trust, That if I fail to pay said debt and interest, on or
before the 1st day of October 1880, then He may sell said property or so much
thereof as may be necessary by public auction, for cash, first giving ten days
notice at three public places in the county and apply the proceeds of such
sale to the discharge of said debt, and interest on the same and costs, and
pay the surplus, if any to me.

SPARROW his wife, personally appeared before me this day, and acknowledged by due execution of the within deed of conveyance; and the said Ann J. SPARROW being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband or any other person, and that she doth still voluntarily assent thereto.

This Indenture, Made this 15 day of January in the year of our Lord One thousand Eight Hundred and eighty between Isaac SPARROW and Ann J. SPARROW of
the County of Lenoir and State of N.C. of the first part, and Ira J. HEATH, Jr. of the County of Lenoir and State of N.C., of the second part: Witnesseth, That the said parties of the first part, for and in consideration of the sum of fifty dollars in hand paid by the said part of the second part, the receipt whereof is herby acknowledged, have Bargained and Sold, Conveyed and Confirmed, and by these presents do bargain, sell, convey and confirm unto the said parties of the second part his heirs and assigns forever, all the following described piece or parcel of land, lying and being in the County of Lenoir in the south side of Trent River and known and designated as follows, viz: Beginning at a lightwood stump and runs N 35 W 126 poles to a gum in buck branch then N 49 E 50 poles to a gum in said branch then S 35 E 126 poles to a stake then N 42? E 70 poles to a stake then S 67 E 114 poles to a stake then S 38 W 68 poles to an oak then S 64 W 148 poles to a stake then N 38 W 69 poles to a stake near the upper barber patch in Jarman DAVIS’ line there with his line to the beginning containing about one hundred and fifty acres. To have and to hold the same, Together with all the hereditaments and
appurtenances thereunto in anywise appertaining. And the said Isaac SPARROW & Ann J. SPARROW parties of the first part, do covenant with the said party of the second part, his heirs and assigns, as follows:
First, That they are the owners, and lawfully seized of said premises. Second, That they have good right to convey the same. Third, That the same is free from all encumbrances whatever. And Fourth, That the party of the second part, his heirs and assigns, shall quietly enjoy and possess the same, and that they will warrant and defend the title to the same against all lawful claims. Provided, nevertheless, That if the said parties of the first part, their heirs, executors and administrators shall well and truly pay, or cause to be
paid to the said Ira J. HEATH, Jr. party of the second part, his heirs, executors, administrators, or assigns, the sum of fifty dollars, according tot he condition of a certain Bond of even date herewith, payable in the first day of December A.D. 1880; then this Deed to be null and void: otherwise to be in full force and effect. But if default shall be made, in the payment of the said sum of money, or the interest, or any part thereof, at the time herein before specified for the payment thereof, the said party of the second part, his heirs, executors, administrators, and assigns, upon written notice to parties of first part, for 90 days, that prompt payment is expected, and in default therof sale will be made under the powers of this Mortgage, to sell the said hereby granted premises at public outcry at the Court House in Kinston after first advertising the same in some newspaper published in said county and convey the same to the purchaser, in fee simple, and out of the moneys arising from such sale, to retain the principal and interest which shall then be due on the said bond together with all costs and charges, and pay the surplus (if any) to the said parties of the first part, their heirs, executors, administrators or assigns.
